No more pre-approval step. Yay! or Nooo - what's your opinion?

Changes that were scheduled for 2018 are now in place. Are you ready? What processes do you have in place?

From 1 July 2020, medicine ads in specified media will not need pre-approval from the TGA. Advertisers must still ensure that their ads meet the requirements under the therapeutic goods legislation, including the Therapeutic Goods Advertising Code.

BUT did you know that all media are subject to the same rules? Training materials, social media posts, in-store brochures, press releases, labels, digital banners - have these been considered?

AND its not only therapeutic goods legislation that must be considered. Consumer law, copyright law, health practitioner laws, food product and cosmetic standards - does your advertising meet these requirements?

Although pre-approval will no longer be necessary from 1 July 2020, the regulation of advertising content remains, with the onus on advertisers to ensure that all their advertising meets the requirements under the therapeutic goods legislation and advertising code …. as well as all the other laws are rules.

A broader range of enforcement powers have been put in place to support a greater self-regulatory approach. Advertisers should be aware that there is a range of offences relating to the unlawful publication or broadcast of a therapeutic product advertisement.
