Celebrity endorsements - Can these be used to promote medicines?

A whole heap of noise erupted in June 2022, shouting that influencers will be banned from promoting health products. Then there were some follow-up fact checks and, for those who were genuinely concerned about their chosen career, it was clarified that’s not quite the case.

What is allowed? Endorsements.

Endorsements are a form of support or approval and can be provided by an individual or a group.

EXAMPLE: ✅Famous footballer is pictured holding a tub of MG Magnesium powder in a staged setting. The advertisement includes claims about how this magnesium could help certain individuals.

EXAMPLE: ✅Entire football team is photographed with the heading “City West Football Club recommends the MG Magnesium range of supplements”

What isn’t allowed?

Although there are some endorsements that are not permitted.

  • Unless permitted by the Regulations or Act, advertising can not include what looks like a government endorsement

  • Endorsement by hospitals or health facilities, or their employees

  • An endorsement that includes a testimonial if the person or group have been paid to share their experience.

EXAMPLE: ❌At City West Football team we use MG Magnesium before and after our intense training session to help with recovery.
